INVITATION TO TENDER FOR THE EXECUTION OF FY2026 CAPITAL PROJECTS (GOODS & WORKS)

1.0 INTRODUCTION
1.1 Abaji Area Council (hereinafter “the Authority”) has budgetary provisions under the FY2026 Capital Appropriation for the execution of various Goods and Works projects.
1.2 In compliance with the Public Procurement Act, 2007, the Authority hereby invites interested, experienced, and competent contractors to submit Technical and Financial bids for the various Goods and Works projects. The Projects and Tender Identification Number (TIN) are as follows:

2.0 PREQUALIFICATION/ ELIGIBILITY REQUIREMENT
All interested companies are to submit copies of the following documents and the original to be made available for sighting during Due diligence exercise.
a. Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including form CAC 1.1 or CAC 2 and CAC 7.
b. Evidence of company’s Income Tax Clearance Certificate (TCC) for three (3) years valid till 31st December, 2026;
c. Evidence of Pension Clearance Certificate as provided in Section 16 Subsection 6 (d) of the public procurement Act, 2007 valid till the 31st December, 2026. (This requirement is only applicable to bidders whose number of staff is 15 and above in line with the PENCOM ACT. However, bidders with less than 15 (fifteen) staff are to provide a Sworn Affidavit to that effect).
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate in Compliance with ITF Act, 2011 as amended valid till 31st December, 2026 (This requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is 50M and above. However, bidders with less than 5 (five) staff or the bidder’s annual turnover less than 50M are to provide a Sworn Affidavit to that effect).
e. Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2026.
f. Evidence of registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December 2026.


g. A recently Sworn Affidavit disclosing (Date not earlier than the date of this advertisement and addressed to Abaji Area Council):
i. Whether or not any officer of the relevant committees of Abaji Area Council or Bureau of Public Procurement (BPP) is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars
ii. That the company is not in receivership, insolvency or bankruptcy
iii. That the company does not have any Director who has been convicted by any court in Nigeria and any other country for criminal offences in relation to fraud or financial impropriety.
h. Company’s Audited Accounts for the last three (3) years for 2023, 2024 and 2025 Stamped/Sealed by a Chartered Accountant.
i. Evidence of financial capacity to execute the project by submission of Reference letter from a reputable commercial bank in Nigeria, indicating their willingness to provide credit facility for the execution of the project when needed. The letter should be addressed to the Chairman, Abaji Area Council.
j. Company’s profile with the curriculum vitae of key staff to be deployed for the project, including copies of their relevant academic/ professional qualifications such as COREN, QSRBN, ARCON, CORBON etc.
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
l. For Works: List of Plants/ Equipment with proof of ownership or lease agreement (where applicable);
m. For Electrical Project: Evidence of current licence issued by Nigerian Electricity Management Services Agency (NEMSA).
n. All documents for submission must be transmitted with a covering letter/ forwarding letter under the company/ firm’s letter head paper bearing amongst others, the registration number (RC) as issued by the corporate affairs commission (CAC), contact address, telephone number (preferably) GSM No.) and email address. The letterhead paper must bear the names and nationality of the directors of the company at the bottom of the page, duly signed by the authorized officer of the firm.

3.0 SPECIFIC ADDITIONAL REQUIREMENTS FOR PREQUALIFICATION
3.1 Prospective bidders for TIN 1, 3, 5, 26, 27, 37 shall provide evidence of Manufacturer’s Authorisation from Original Equipment Manufacturer (OEM);
3.2 Bidders for TIN 32 & 33 shall possess a minimum average annual turnover of N100,000,000.00 for the last three (3) years, evidenced by audited accounts.

4.0 COLLECTION OF TENDER DOCUMENTS
4.1 Interested companies/bidders are to collect the Standard Bidding Document (SBD) from the OFFICE of DIRECTOR OF WORKS, ABAJI AREA COUNCIL SECRETARIAT, ABAJI, FCT- ABUJA, on presentation of evidence of payment of a NON-REFUNDABLE tender fee of N50,000.00 per TIN, paid in BANK DRAFT to Abaji Area Council from any Commercial Bank in Nigeria.

5.0 SUBMISSION OF BID DOCUMENTS
5.1 Format: Bidders shall prepare Technical Bid and Financial Bid as separate documents. Each bid shall contain one (1) original and two (2) photocopies, each bound and sealed in separate envelopes clearly marked TECHNICAL BID or FINANCIAL BID with the Project Title, TIN, and Lot Number. The two envelopes shall then be placed into a single outer envelope sealed and addressed as in 5.2 below.
5.2 Address outer envelope to:

5.3 Submission point & deadline: Deliver the sealed outer envelope to the Tender Box at the Council Conference Hall, Abaji Area Council Secretariat and sign the Tender Submission Register at the Department of Works. Deadline: 12:00 noon on 17th August, 2026.

6.0 OPENING OF BIDS
6.1 Technical bids will be opened immediately after the deadline on 17th August, 2026 at 12:00 noon at the Council Conference Hall, Abaji Area Council Secretariat.
6.2 Bidders or their representatives are invited to attend the bid opening. Interested members of the public may also be present.
6.3 Only bidders whose Technical bids are successful will be invited to the subsequent opening of Financial Bids. Financial bids of unsuccessful bidders will be returned unopened.

7.0 IMPORTANT NOTES
i. Late submissions will be returned unopened;
ii. This advertisement shall not be construed as a commitment on the part of Abaji Area Council, nor shall it entitle any bidder to make any claim or seek indemnity;
iii. Bidders must be clear about the Lot(s) for which they are bidding. No bidder shall bid for more than three (3) Lots. Violation leads to disqualification from all Lots;
iv. Bids must be in English Language and signed by an official authorized by the bidder;
v. The authorized official shall be introduced to the Authority by a Letter of Authority duly signed by the Director and Secretary of the Company;
vi. All pages of the Financial Bid must be duly endorsed (signed) by the authorised representative;
vii. Bid Security: For bids with tender sum exceeding N100 Million (Goods) or N300 Million (Works), a Bid Security of 2% of the tender sum in the form of a Bank Guarantee from a reputable Nigerian bank must be submitted;
viii. Performance Guarantee: Successful bidders may be required to provide a Performance Guarantee/Bond of 10% of the contract sum before signing the contract;
ix. Due diligence will be conducted to verify all claims; submission of fake documents is a fraudulent act punishable under Nigerian law;
x. All costs in respect of the bid will be borne by the bidders;
xi. The Bids will be opened in the presence of Bidders or their representatives and other interested members of the general public
xii. The Authority is not bound to pre-qualify any bidder and reserves the right to annul the procurement process at any time without incurring liability, in accordance with Section 28 of the Public Procurement Act, 2007;
