INVITATION TO TENDER FOR WORKS AND GOODS FOR FY2026 CAPITAL PROJECTS
1.0 INTRODUCTION
1.1 The Benin-Owena River Basin Development Authority (BORBDA), hereinafter referred to as “the Authority”), a Parastatal of the Federal Ministry of Water Resources and Sanitation, is desirous of executing her FY2026 Capital Projects. In compliance with the Public Procurement Act, 2007, the Authority hereby invites interested, experienced and competent Contractors to submit bids for the implementation of the following projects:
2.0 SCOPE OF WORKS/GOODS
The Scope of Works & Goods are categorised and packaged into LOTs as shown in the table below:

3.0 ELIGIBILITY REQUIREMENTS
a. Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7.;
b. Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all Partners in case of Business Name) for the last three (3) years (2023, 2024 & 2025) valid till 31st December, 2026;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2026 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2026 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2026;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2026 or valid Certificate issued by BPP;
g. Sworn Affidavit:
– disclosing whether or not any officer of the relevant committees of the Benin-Owena River Basin Development Authority or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
– that no Director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter;
– that the Company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceedings;
– That the company does not have existing loan or financial liability with a bank, other financial institution or third party that is classified as doubtful, non-performance, bad or whose repayment portion has been outstanding for the last four (4) months;
h. Company’s Audited Accounts for the last three (3) years – 2023, 2024 & 2025;
i. Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON etc.;
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
l. Consultancy Services: Evidence of Firm’s current registration with the relevant regulatory professional body(ies) such as COREN, QSRBN, ARCON, CORBON etc. (where applicable);
m. Works: List of Plants/Equipment with proof of Ownership/Lease Agreement;
n. Electricity Jobs: Evidence of current Licence issued by Nigerian Electricity Management Services Agency (NEMSA);
o. For Joint Venture/Partnership, Memorandum of Understanding (MoU) indicating Lead Partner should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner);
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letterhead Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.
4.0 COLLECTION OF TENDER DOCUMENTS (INVITATION TO TENDER)
Interested companies are hereby notified that the Standard Bidding Document (SBD) shall be issued in soft copy format (specifically on a Compact Disk). This will be obtainable from the Office of the Head of Procurement Unit, Room 067, Ground Floor, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor, upon presentation of evidence of payment of a NON-REFUNDABLE tender fee of Ten Thousand Naira (N10,000.00) per Lot.
Payment shall be made into the Benin-Owena River Basin Development Authority’s Remita account through any reputable Commercial Bank in Nigeria. Bidders are required to generate a Remita Retrieval Reference (RRR) and pay into the BORBDA Remita e-collection IGR Account Number 025203800100 in any Commercial Bank in Nigeria.
The GIFMIS code for the Tender fees is 1000020623.
5.0 SUBMISSION OF BID DOCUMENTS
5.1 Prospective bidders for Invitation to Tender (Categories B & C) are required to submit their bids as follows:
– Technical Submissions: Soft copies of the technical bid shall be submitted — on a flash drive packaged in a sealed envelope clearly marked “Technical Bid” and to our email (procurement@beninowena.gov.ng) as well as this link (https://mega.nz/filequest/p3rajFmVGRE)” (the email and link will be provided alongside the Standard Bidding Documents in the CD during collection of tender documents)
– Financial Submissions: The financial bid created only in MS-Excel format shall be submitted in hard copy only, packaged separately in a sealed envelope clearly marked “Financial Bid.”
Thereafter, the two sealed envelopes (Technical and Financial) shall be placed together in a larger envelope, clearly marked with the name of the project and the Lot number at the top right-hand corner. The reverse side of each sealed envelope must bear the name and address of the bidder
5.2 Each sealed envelope of bidders should be addressed to:

This should be delivered and receipted for at the Procurement Unit and dropped in the designated Tender Box in the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor.
5.3 Inclusion of a bid security of 2% of the bid price for Works of Three Hundred Million Naira (N300m) and above; and for Goods of One Hundred Million Naira (N100m) and above.
6.0 OPENING OF TECHNICAL BIDS
6.1 The Technical bids will be opened immediately after the deadline for submission in the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor as follows:

6.2 Bidders should please ensure that they sign the Bid Submission Register in the office of the Head, Procurement Unit, Ground Floor, Room 067, BORBDA Headquarters Complex, Km 24, Benin/Sapele Road, Obayantor, as the Benin-Owena River Basin Development Authority will not be held liable for misplaced or wrongly submitted bids. 7.0 GENERAL INFORMATION
a. Bids must be in English Language and signed by an official authorised by the bidder;
b. The authorised official shall be introduced to the Authority by a Letter of Authority duly signed by the Director or Secretary of the Company;
c. Bids submitted after the deadline for submission would be returned un-opened;
d. Bidders should not bid for more than two (2) Lots, violators shall be disqualified from all the Lots;
e. All costs will be borne by the bidders;
f. Invitation to Tender: Only pre-qualified bidders at the technical evaluation stage will be contacted for the opening of the financial bids. The financial bids of non-prequalified bidders will be returned unopened.
g. The Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies; and will be covered by video recording; invitation links will be sent to bidders who choose to join the bid opening online;
h. Bid documents from Bidders can submit through post (Courier Services). Bids submitted through post must be received before the deadline for submission of bids, otherwise the bid will be returned unopened;
i. The Benin-Owena River Basin Development Authority is not bound to pre-qualify/shortlist any applicant and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
